• "Services" — refers to AI integration consulting, HR analytics implementations, RPA training programmes, and intelligent dashboard development offered by Jejak AI.
• "Website" — refers to the website accessible at jejakaimy.info and all associated pages.
• "Agreement" — refers to the binding contract formed when you accept these Terms and engage our services.
• "Content" — refers to all text, data, materials, and deliverables produced in connection with the Services.

2. Acceptance of Terms

By visiting our website, submitting an enquiry, or entering into a service engagement with Jejak AI, you confirm that you have read, understood, and agreed to these Terms and Conditions. You also confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are acting on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

3. Service Description

Jejak AI provides the following professional services to organisations in Malaysia and the surrounding region:

• AI-Powered HR Analytics — workforce analytics implementations covering attrition modelling, talent matching, and engagement scoring, with data privacy safeguards aligned to PDPA 2010.
• Robotic Process Automation Training — structured hands-on programmes teaching teams to design, build, and govern RPA workflows using industry-recognised platforms.
• Intelligent Dashboard Creation — consulting and development services for AI-enhanced dashboards with predictive analytics, anomaly detection, and integrated user training.

The specific scope, deliverables, timeline, and pricing for each engagement are agreed upon in a separate written proposal or service agreement prior to commencement of work.

4. User Responsibilities

When using our website or engaging our services, you agree to:

• Provide accurate and complete information in any communications or forms
• Use the website and our services only for lawful purposes
• Not attempt to access systems, data, or content you are not authorised to access
• Not use the website in any manner that may damage, disable, or impair its operation
• Cooperate with our team during service delivery, including providing timely access to data, systems, or stakeholders as agreed

5. Intellectual Property

All content on the Jejak AI website — including text, design, graphics, and code — is the intellectual property of Jejak AI and is protected under applicable Malaysian law. You are granted a limited, non-exclusive, non-transferable licence to access and use the website for informational purposes only.

In respect of service deliverables, ownership of custom-developed artefacts (such as dashboards, trained models, or workflow documentation) will transfer to the client upon full payment, unless agreed otherwise in writing. Jejak AI retains the right to use general methodologies, frameworks, and non-client-specific knowledge developed during engagements for future work.

6. Payment Terms

Service fees are denominated in Malaysian Ringgit (RM) and are as quoted in our current service listings or agreed upon in a written proposal. The following payment conditions apply:

• A deposit of 50% of the agreed fee is required to confirm and commence an engagement
• The remaining balance is due upon completion of the agreed deliverables or milestones
• Payment may be made via bank transfer to account details provided in the invoice
• Invoices are due within 14 days of the invoice date unless otherwise agreed in writing
• Prices listed on our website are indicative and subject to scope confirmation

Refund Policy: If an engagement is cancelled before work commences, the deposit is refundable less any reasonable administrative costs. Once work has commenced, refunds are assessed on a case-by-case basis based on work completed to date.

7. Service Delivery Terms

We aim to deliver all services within the timelines agreed in our written proposals. Timelines may be affected by the availability of client data, access to internal systems, and stakeholder responsiveness. Where delays arise due to client-side factors, we will communicate openly and adjust delivery schedules accordingly.

Any significant change in project scope requested after commencement may result in a revised timeline and additional fees. Such changes will be documented and agreed upon in writing before implementation.

8. Confidentiality

Both parties agree to maintain the confidentiality of any sensitive business, technical, or personal information shared during an engagement. This obligation continues for a period of two years following the conclusion of the service engagement. Neither party will disclose confidential information to third parties without prior written consent, except where required by law.

9. Disclaimers

Our website and services are provided in good faith and with professional care. However, we note the following:

• AI and data analytics outputs are probabilistic in nature and should be used as decision-support tools, not definitive conclusions
• We do not guarantee that any specific business outcome will result from the use of our services
• The accuracy of analytics outputs depends significantly on the quality and completeness of input data provided by the client
• Our website is provided "as available" and may be subject to interruptions for maintenance or technical reasons

10. Limitation of Liability

To the fullest extent permitted by Malaysian law, Jejak AI's total liability arising from any service engagement shall not exceed the total fees paid by the client for that specific engagement. We shall not be liable for any indirect, incidental, or consequential loss including but not limited to lost revenue, data loss, or business interruption, whether arising from contract, negligence, or otherwise.

11. Indemnification

You agree to indemnify and hold harmless Jejak AI, its team members, and affiliates from any claims, damages, costs, or liabilities arising from your misuse of our website or services, your breach of these Terms, or your violation of any applicable law or third-party rights.

12. Termination

Either party may terminate a service engagement by providing 14 days' written notice, subject to the payment terms outlined in Section 6. We reserve the right to suspend or terminate access to our website or services immediately if we believe these Terms have been materially breached. Sections 5 (Intellectual Property), 8 (Confidentiality), 10 (Limitation of Liability), and 13 (Governing Law) survive termination.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms or your use of our services shall first be referred to good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be submitted to mediation under the auspices of the Malaysian Mediation Centre before any formal legal proceedings are initiated.

Where legal proceedings become necessary, both parties agree to submit to the exclusive jurisdiction of the courts of Sabah, Malaysia.

14. General Provisions

• Entire Agreement: These Terms, together with any written service proposal, constitute the entire agreement between us in relation to their subject matter.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
• Waiver: Failure to enforce any provision of these Terms on one occasion does not constitute a waiver of future enforcement rights.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
• Notices: Formal notices should be sent to the contact details provided below.

15. Changes to These Terms

We may update these Terms and Conditions periodically to reflect changes in our services or applicable law. The updated date at the top of this page reflects when the most recent version took effect.
